General Terms and Conditions of Rental

Please read these terms carefully before completing your booking or signing the rental agreement.

Note: This English version is provided for the customer's convenience. In the event of any discrepancy between the Spanish and English versions, the Spanish version shall prevail.

1. Use of the vehicle

The renter receives the described vehicle in perfect condition and undertakes to drive it in accordance with the applicable traffic and road regulations, and to return it in the same condition in which it was delivered, accepting responsibility for the vehicle throughout the rental period, including damage, defects, theft, fire or any other loss arising from its use.

The renter authorises the rental company to recover the rented vehicle if it is found unlocked, badly parked, abandoned, with an expired contract, or in the event of serious breach of contract, dangerous driving, unauthorised use, unlawful use or misuse of the vehicle.

The following shall be considered misuse, among others: reckless or negligent driving; driving under the influence of alcohol, drugs or medication incompatible with driving; driving on roads or paths unsuitable for the vehicle; overloading the vehicle; participation in competitions or sport driving; use for purposes other than those intended by the manufacturer; tampering with mechanical, electrical or limiting components of the vehicle; and driving by unauthorised persons. On unpaved roads, improper driving shall include any conduct that causes damage resulting from impacts, jumps, skids, hits to the underbody, transmission, suspension, clutch or tyres inconsistent with normal use of the vehicle.

The renter further undertakes:

A) not to use the vehicle for the transport of goods or items, nor to push or tow other vehicles;
B) not to lend, sub-lease the vehicle or use it in sporting events;
C) not to take the vehicle off the island of Formentera, nor to allow it to be taken, being in such case fully liable for all expenses, damage and defects the vehicle may suffer, with no excess limit, as well as for transport costs and/or return to the agreed point;
D) not to smoke inside the vehicle.

The renter and any authorised driver must present a valid identity document and a valid driving licence, suitable for the vehicle rented. For bicycles and electric bicycles, a valid identity document shall suffice, without prejudice to the applicable traffic regulations.

2. Return of the vehicle, liability for damage and security deposit

The vehicle must be returned to the place and on the date specified in the contract and, where no place is specified, to the same delivery point. The renter undertakes to notify the return and location of the vehicle when this takes place outside a Formentera Motos physical office or established opening hours. In the event of an early return, the renter shall not be entitled to a refund of the rental fee or of any additional coverage purchased. The renter shall be liable for any delays and the costs arising from them. Late return shall incur a surcharge of €30 plus VAT per hour or part thereof.

The renter shall be liable for any damage and defects caused to the vehicle during the rental period up to a maximum of €600 for bicycles, €1,200 for electric bicycles, mopeds and motorcycles, and €4,000 for cars, in addition to any costs arising from recovery, transport or immobilisation of the vehicle.

The renter may optionally request enhanced liability reduction coverage, subject to acceptance by Formentera Motos. The enhanced coverage applies exclusively to accidental damage occurring on the island of Formentera and shall not cover damage to wheels, tyres, rims or the underbody, interior damage, loss or breakage of keys, loss, theft or damage of helmets or accessories, theft due to negligence, incorrect refuelling, negligent driving or misuse, driving under the influence of alcohol or drugs, or damage arising from driving outside suitable roads or off the island of Formentera. The enhanced coverage shall be automatically void in the event of expiry of the rental period, as well as in any of the cases described as misuse of the vehicle or the cases not permitted in the section on use of the vehicle.

Formentera Motos may withhold the security deposit in full or in part to cover duly justified damage, penalties, expenses or contractual breaches. The security deposit shall cover damage, defects, late returns, fuel, cleaning, fines, loss of accessories or any other amount arising from this contract, and shall be returned or released once the vehicle has been inspected and any outstanding amounts settled.

3. Cancellations

Cancellations made up to 24 hours before the start of the rental may be made free of charge. For later cancellations, no-shows or unjustified delays exceeding 5 hours without prior notice, Formentera Motos may retain the amounts paid or apply the charge corresponding to the first day of rental.

Delays caused by justified incidents involving flights, ferries or adverse weather shall not be considered no-shows, provided the customer notifies them as soon as possible. Once the rental has started and the vehicle has been collected, no refunds will be issued for days not used or for early returns, except in exceptional cases assessed individually by Formentera Motos.

4. Accidents

The renter shall be solely liable for the civil, administrative and criminal consequences arising from the improper, unlawful or negligent use of the vehicle during the rental period. The vehicle is covered by a third-party liability insurance policy and the renter undertakes to comply with the terms and conditions of that policy.

In the event of an accident, theft, damage or breakdown, the renter must notify Formentera Motos immediately, not admit or assume liability towards third parties except where legally required, obtain wherever possible clear photographs and videos of the scene, damage to the vehicles involved, registration plates, third-party documentation and witness details, request police intervention where third parties are involved, where there is significant damage, injury or no agreement is possible between the parties, and take all reasonable measures to prevent further damage to the vehicle. Serious breach of these obligations may result in the loss of any additional coverage purchased.

Should the vehicle become unusable for any reason or in the event of theft or accident, Formentera Motos shall not be liable for any belongings left inside the vehicle before, during or after the rental period. Formentera Motos accepts no liability for delays or losses arising from breakdowns, accidents or other causes beyond its control.

5. Personal belongings

Formentera Motos accepts no liability for loss or damage to items left, stored or transported in the vehicle during or after the rental period. Helmets and accessories delivered with the vehicle shall be the renter's sole responsibility.

6. Other services and cleaning

The renter shall bear the costs arising from the loss of keys and from any call-out or assistance caused by misuse, negligence or loss of components or accessories of the vehicle. The minimum call-out cost shall be €30, rising to €50 if a van, truck or tow truck is required. Assistance provided by Formentera Motos shall be carried out within the office or service hours in force at the time. Formentera Motos reserves the right to charge for roadside assistance in the event of recklessness or lack of care by the renter.

The vehicle must be returned in a reasonable state of cleanliness. The following shall be considered excessive dirt, among others: sand, mud, salt, moisture, stains, rubbish, strong odours or dirt on upholstery, seats, mats, ceilings or interiors that require specialist cleaning beyond ordinary cleaning. In such cases a cleaning surcharge of €50 or more may apply.

The renter expressly authorises Formentera Motos to charge the card provided as a guarantee for damage or defects, excess, fuel or recharging, cleaning, loss of accessories or keys, fines and administrative costs, late returns and assistance services, always related to this contract and duly justified.

7. Fuel and battery

It is the renter's responsibility to check the fuel and/or battery level of the vehicle from the start of the rental and to refuel or recharge it correctly. Unless otherwise stated, the vehicle is delivered with the fuel or battery level shown in the contract and/or recorded through photographs or videos taken at the time of delivery, and must be returned in the same condition.

For mopeds, motorcycles and other electric vehicles, in the event of return with a lower fuel or battery level, a minimum charge of €15 will be applied for refuelling or recharging and service. For cars whose indicator uses segments or bars, a charge of €15 will be applied for each segment or bar missing compared to the level at the time of delivery.

The use of incorrect fuel shall be the renter's sole responsibility, including all costs arising from cleaning, draining, repair and refuelling of the vehicle. In the event of return with a higher level than originally delivered, no refund or compensation shall be given.

8. Fines and penalties

The renter shall be liable for payment of fines and penalties arising from breach of the applicable road and traffic regulations. The renter further undertakes to provide accurate and up-to-date personal details of the responsible driver and authorises Formentera Motos to communicate these details to administrative or judicial authorities or law enforcement bodies where necessary for the handling of penalties, accidents, claims, contractual breaches or by legal obligation.

If the fine is not paid within the reduced or prompt-payment period set by the relevant authority, the renter authorises Formentera Motos to apply an additional charge of €20 to cover administrative handling and processing costs.

9. Data protection

The personal data provided by the renter will be processed by Formentera Motos for the purposes of managing bookings, rental contracts, payments, incidents, insurance, administrative penalties and complying with legal obligations. The data may be disclosed to insurers, banks, payment platforms, garages, assistance services, administrative or judicial authorities or law enforcement bodies where necessary for the provision of the service or by legal obligation. The renter may exercise their rights under the applicable regulations by means of a request addressed to Formentera Motos.

10. Jurisdiction

Any dispute that may arise between the renter and the rental company shall be submitted to the courts and tribunals of Ibiza and Formentera (Spain) where the applicable law so permits.

11. Acceptance and inspection of the vehicle

The renter declares that they have read, understood and accepted these terms and that they have inspected the vehicle, receiving it as agreed except for any damage expressly noted in the contract or evidenced through photographs or videos taken before the start of the rental. The condition of the vehicle may be evidenced by photographs, videos or inspections carried out at the time of delivery and return.
